Scooter Update

Since so many of you have been inquiring, I figure I need to update you on the status of "Scooter vs. The Evil Association." So, here's the dealio:

Silence.

Yup. That's why I haven't really reported anything -- because we have heard nothing further. We submitted our argument via email and a hard copy statement that was sent via fax, and presently there's nothing more to do until we hear back from the board, which could be days, could be weeks, could be months. A friend sent some of our association documents to another friend, who is a lawyer, and she essentially said the ultimate decision will be up to the board, and we don't have much of a legal foothold to support our argument. She said that decisions like this really depend on the board members, so we are subject to their mercy on the matter.

In the meantime, I had to convince my husband to not call the real estate agent -- just yet.

On Tuesday, he literally had phone in hand and was making plans for selling our condo and he already had a tentative lists of properties in the area he wanted to see. I had to reign him in. True, I think this incident has reinforced how badly we'd like a single family home, instead of a condo, and true, I think we can afford it. But I would prefer to not act hastily. So, I made him a deal: If the association comes back to us and says Scooter has to go, then we will put the condo on the market immediately and we will look to purchase another home, one where Scooter's residence won't be an issue; If the association comes back to us and says that Scooter can stay, we can still plan for a new home, but he (my husband) has to wait at least six months before looking.

So, that's Scooter's story.

As for me? I discovered this morning that I've been drinking milk that expired 3 days ago. Tasted fine. But if I keel over later today, you'll know why.

Poor Scooter. Hope the board members have a little compassion.
Maybe you should send them all a complimentary glass of your expired milk to try to suck up. And if they happen to keel over from drinking it, well ... there could be worse things, right?

I really believe that taking any sort of action (beyond the initial letter) would involve way more effort and paperwork than the HOA is willing to endure. They are there to collect way too much money, establish widely broken covenants, organize law/trash/road activities, and not much else as far as I can tell. But I would make efforts to get it changed by the combined presence of all you criminal pet harborers.

I'm pulling for Scooter! Hopefully the HOA puts their head in the sand on this one.

As far as the milk goes: if it smells okay and doesn't look like cottage cheese you're good to go...

I was thinking the same thing as Lisa, gosh you guys did all that great work on the condo. I'm pulling for Scooter!! ;D ;D Hopefully everything will work out in the end :-)

As far as the milk goes . . .I can't even tell you how many times I've done that and I'm good (that is subject to each individual's interpretation I suppose LOL)

I am like Jerry--reactionary...I would have moved out by now! But you are right, you have time. If those A-holes say Scooter goes...then it is for the best and a new home is in your near future. If not, I still think a new home is in your future..but on your terms...better yet. Either way I predict Scooter will be lifting his leg on an association members lawn very soon! You go Scooter!

Totally relate to the desire to not act hastily. Take it from someone who just made a hasty move: It's nothing but stressful.

I drink milk that's past expiration all the time. It's not bad for at least 5 days past that date -- and organic milk seems to keep even longer. Sometimes there's a "sell by" date, and I find that date to be the real indicator of spoiled milk.

Scooter has great parents ...maybe a bigger backyard? I would've moved already :-/

At least it wasn't breast milk :p

It's funny -- if this happened to me (I have two cats and live in a house, so it wouldn't, but one of my cats was technically "illegal" when I lived in my last apartment), I would be the one freaking out and putting the house on the market, while my husband would be cool as a cucumber.

I agree with David. I just attended our HOA meeting on Thursday and saw the list of attached fines for the homeowners. There were hundreds of fines ranging from $5 (not sure what that is for - dirty mailbox perhaps?) to over $2000 dollars. I'm guessing the people with over $2000 have been racking them up for a while and they're still around! :)

I'm always amazed how milk can turn poisonous the minute you cross that deadline. I like to think you have a few days grace period instead.
